Terms & Conditions

Welcome to Upside Down Racing. By booking a service, dropping off a vehicle, or authorizing work, you (the "Customer") agree to be bound by the following Terms & Conditions.
 

1. Service Authorization

By engaging Upside Down Racing for repair, maintenance, or modification services, the Customer authorizes our employees to perform the work described in the work order. This includes permission to operate the vehicle on public streets or at testing facilities for diagnostic evaluation, road testing, inspection, and delivery.
 

2. Pre-Existing Damage

The Customer acknowledges that vehicles may possess existing defects, including but not limited to:

• Cosmetic damage (scratches, dents, paint chips)

• Worn mechanical components

• Structural irregularities

• Undisclosed aftermarket modifications

Upside Down Racing shall not be held liable for the discovery or exacerbation of pre-existing mechanical failures or "hidden damage" that becomes apparent during the normal course of service.
 

3. Aftermarket & Performance Parts

The installation of aftermarket or performance modifications may significantly alter a vehicle’s reliability, handling, emissions compliance, and original manufacturer warranty.

• Liability: Upside Down Racing is not liable for damages resulting from manufacturer defects in third-party parts or failures caused by the nature of performance modifications.

• Customer-Supplied Parts: If the Customer provides their own parts, Upside Down Racing offers no warranty regarding labor, fitment, or long-term compatibility. The Customer expressly releases Upside Down Racing from any liability arising from the use of supplied parts.

4. Additional Repairs

If additional necessary repairs, safety concerns, or parts are identified during service that were not in the original estimate, work will cease on the affected area. We will make reasonable efforts to contact the Customer for verbal or written authorization before proceeding with supplemental services.
 

5. Payment & Storage Fees

• Payment: Full payment for parts, labor, and authorized services is due upon completion and prior to the release of the vehicle.

• Storage: Any vehicle remaining on the property for more than 48 hours following notification of completion will be subject to a daily storage fee of $10 per day until the balance is settled.

• Mechanic’s Lien: Pursuant to applicable state statutes, Upside Down Racing reserves a mechanic’s lien on the vehicle and its contents to secure payment and may retain possession of the vehicle until all charges are paid in full.

6. Limited Liability & Indemnification

Upside Down Racing’s liability for any breach, negligence, or tort shall be strictly limited to the total dollar amount paid by the Customer for the specific services rendered.

• Excluded Damages: We are not liable for incidental, indirect, or consequential damages, including loss of use, towing fees, rental expenses, or missed race event fees.

• Indemnification: The Customer agrees to indemnify and hold Upside Down Racing harmless from claims arising from operations outside the scope of work or risks inherent to high-performance modifications and testing.

7. Satisfaction & Inspection Policy

The Customer is responsible for inspecting the vehicle immediately upon pickup.

• Reporting Window: Any claims regarding workmanship or damage must be reported in writing within 24 hours of the vehicle leaving our facility.

• Waiver: Failure to report issues within this 24-hour window constitutes an absolute waiver of any claim.

8. Photo & Media Documentation

The Customer consents to the use of digital photography and/or video to document the condition of the vehicle before, during, and after service. These records are used for internal documentation and quality insurance.
